These Terms govern access to and use of the website www.retx.pt, as well as the legal relationship between RETX and its users and clients.

They apply to all users of the website, whether RETX clients or mere visitors.

By accessing and using this website, the user declares having read, understood and fully accepted these Terms, in compliance with:

• Decree-Law no. 7/2004, of 7 January (E-Commerce Law)
• Decree-Law no. 24/2014, of 14 February (Distance contracts)
• Law no. 24/96, of 31 July (Consumer Protection)
• Portuguese Civil Code
• EU Regulation 2016/679 (GDPR), where applicable

RETX provides the following services, depending on the scope agreed with each client:

• Custom websites and online stores
• Web design, visual identity and branding
• Search engine optimisation (SEO) and online visibility
• Digital consulting
• Hosting and maintenance plans for websites — available both for sites built by RETX and for third-party WordPress sites, subject to an initial audit

Hosting and maintenance plans are provided as monthly or yearly subscriptions with no lock-in, billed via Stripe. Plans do not include new features, structural changes, content creation or marketing — those, if requested, are quoted separately.

Before entering into any contract, RETX makes available to consumers:

• Full identification of the service provider
• Essential characteristics of the services
• Total price, including taxes
• Payment and delivery terms
• Information about the right of withdrawal
• Contract duration and termination conditions

Under Portuguese and EU law, consumers entering into a distance contract with RETX have the right to withdraw, without giving any reason, within 14 days from the date the contract is signed.

Exceptions: The right of withdrawal does not apply to service contracts after the service has been fully performed, where performance began with the consumer's prior express consent.

All content on this website — including text, images, photographs, illustrations, logos, icons, graphic design, layout, source code and software — is the property of RETX or its respective rights holders, and is protected by:

• Portuguese Copyright and Related Rights Code (DL 63/85)
• Portuguese Industrial Property Code (DL 110/2018)
• EU Directive 2001/29/EC
• Other applicable national and EU legislation

The user agrees to:

• Use the website lawfully, respecting applicable law, good practice and public order
• Provide truthful, accurate and up-to-date information when requested
• Not use the website for unlawful, fraudulent or harmful purposes
• Not introduce viruses, malware or other harmful elements
• Not attempt to access restricted areas without authorisation
• Not reproduce, copy, distribute or modify content without authorisation
• Respect the intellectual property rights of RETX and third parties

To the maximum extent permitted by Portuguese law:

• RETX does not warrant that the website is free of errors, viruses or other harmful elements, nor that it operates uninterruptedly
• RETX is not liable for direct, indirect, incidental or consequential damages arising from the use or inability to use the website
• RETX is not liable for any technical failures or unavailability of the website

This website may contain links to third-party websites, provided solely for the user's convenience. The inclusion of such links does not imply association, partnership or endorsement by RETX.

RETX neither controls nor is responsible for the content, privacy policies or availability of third-party websites. The user accesses them at their own risk.

The processing of personal data through this website is governed by our Privacy Policy, drafted in compliance with EU Regulation 2016/679 (GDPR) and Portuguese Law 58/2019.

The use of cookies is governed by our Cookie Policy.

Services provided by RETX are subject to the legal warranties set out in Decree-Law no. 84/2021 of 18 October (consumer rights for digital goods and services).

RETX shall not be liable for non-performance or delay arising from circumstances beyond its reasonable control: natural disasters, war, terrorist acts, pandemics, strikes, power or telecommunications failures, legislative changes, or other force majeure events.

RETX reserves the right to amend these Terms at any time. Changes take effect immediately upon publication. We recommend checking this page regularly.

These Terms are governed by Portuguese law.

The competent court for dispute resolution is the Braga district (Portugal), RETX's headquarters, without prejudice to mandatory consumer protection rules applicable to the user in their country of residence.
